A human rights lawyer, Mr Femi Falana, has declared as illegal, the attempt by the Senate ad hoc committee to question embattled lawmaker, Senator Elisha Abbo, on Tuesday.
Falana disclosed that the right of the Senate to discipline its members notwithstanding, Abbo would be held for sub judice if he had answered the questions as the matter was already in court and commenting on it ultra vires the law.
He observed that Abbo had already been arraigned before a magistrate court, and even pleaded not guilty before being granted bail.
The senior advocate also pointed out that the Senate rules also barred the institution from discussing matters that are already in Court.
The activist said, “We all watched the video showing the senator allegedly assaulting a lady but we all demanded justice and the police have already arraigned him. The matter is now before a court and Senator Abbo is a defendant.
“It is, therefore, wrong for the Senate to sit and investigate a matter publicly while the matter is ongoing in court. That is sub judice. The Senate rules are clear that when a matter is in court, the Senate does not dabble into it.”
